One Week into Korea’s AI Framework Act: The Long Shadow Behind the “World’s First” Title

On January 22, 2026, South Korea claimed the flashy title of implementing the “World’s First Comprehensive AI Framework Act.” The government and National Assembly hailed this as the launchpad that would propel Korea into the ranks of the global AI “G3.” However, exactly one week later, the atmosphere on the ground feels less like a celebration and more like a cold awakening.
Last October, we published an article titled <South Korea’s AI Framework Act: Navigating Opportunities and Challenges Before Enforcement>, in which we cautiously predicted the confusion that an unprepared regulatory environment might bring. At the time, we warned that “uncertainty in the law could slow the pace of innovation.”
Regrettably, the reality of January has proven to be even harsher than our concerns. The law has opened its doors, but the market is not yet ready to walk through them. Here is a deep dive into the “real voice” of the Korean AI ecosystem during its first week of enforcement.

1. The Numbers Don’t Lie: The Real Reason Behind “98% Unpreparedness”

The statistics released just before the law’s enforcement were jarring. According to a survey by Startup Alliance, 98% of 101 domestic AI startups had not established a substantial response system compliant with the new law.
The details are even more concerning. nearly half of the respondents (48.5%) admitted they “did not know the contents of the law and were completely unprepared,” while another 48.5% stated they were “aware of the law but their response was insufficient.” Aside from a prepared 2%, the entire ecosystem essentially faced enforcement defenseless.
Why is this happening? It is not due to negligence. For early-stage startups, “regulatory compliance” is an existential luxury. If designated as a “High-Impact AI” provider, a company must implement risk management systems, ensure explainability, and document data processes—tasks that are virtually impossible without a dedicated legal team or expensive consulting. As one industry insider desperately put it, “We are struggling to pay one developer; retaining legal counsel is a pipe dream.”
The government attempted damage control by hastily convening a briefing for 200 industry representatives on January 28—six days after enforcement began. However, critics argue this is a classic case of “closing the barn door after the horse has bolted.”

2. The “Human-in-the-Loop” Loophole: A New Gray Zone

Another detonator for confusion is the definition of “High-Impact AI.”
The Act defines High-Impact AI as systems affecting critical areas like healthcare, hiring, and loan screening, which have a significant impact on fundamental rights. However, a caveat exists: “If a human intervenes in the final judgment, it may be excluded from regulation.”
While the government explains this as flexibility to prevent over-regulation, the industry views it as a dangerous “gray zone.”
  • The Temptation of Formalism: There is a high probability that companies will create “rubber-stamping” processes—where humans merely sign off on AI decisions without substantive review—simply to evade regulation.
  • Ambiguity of Liability: When issues arise, legal battles will likely erupt over whether the error lies with the AI system or the human who approved it.
Ultimately, a clause designed for safety is ironically forcing companies to ponder, “How can we formally insert a human to bypass the rules?”

3. A Tilted Playing Field: The Burden of Reverse Discrimination

Perhaps the most painful point since enforcement began is the stark “Regulatory Gap” between domestic companies and global tech giants. Domestic platform leaders like Naver and Kakao entered the regulatory crosshairs immediately. They are pouring massive resources into watermarking AI generation, mandating transparency notices, and managing algorithm bias. For these companies, which have headquarters and physical assets in Korea, regulatory violation leads directly to fines and reputational damage.
The situation is different for global big tech. The law mandates that overseas operators meeting certain criteria designate a “Domestic Agent.” However, skepticism remains regarding the effectiveness of this measure. For instance, if a new global player like Elon Musk’s xAI chooses not to designate a domestic agent—or designates a shell company with no real authority—enforcement becomes tricky. The Korean government cannot easily raid a headquarters in California or forcibly shut down a service.
This limit on enforcement power threatens to entrench a structure of reverse discrimination. Domestic companies are crying foul, arguing that “Global giants treat Korean law as a mere reference, while we are running the race with sandbags tied to our ankles.”

4. Misalignment with the EU: The Risk of “Galapagos Regulation”

Looking outward, another problem emerges: alignment with global standards, specifically the EU AI Act. The EU’s law is highly specific regarding data governance, bias prevention, and fundamental rights impact assessments for High-Risk AI. In contrast, Korea’s Framework Act is relatively declarative and less specific regarding bias prevention or redress procedures for data subjects.
Why is this a problem? There is a risk that Korean companies developing AI models compliant with domestic laws might face a “substandard” verdict when expanding to the EU. A service legal in Korea could be illegal in Europe, or require a complete system redesign to meet export standards. In the rush to secure the “World’s First” title, we must ask if we missed the crucial step of fine-tuning alignment with global regulatory currents.

5. Moving Forward: From “Regulation” to “Trust” in 2026

Our predictions have become reality. Now, we need practical solutions to utilize the “Golden Time” of 2026, rather than dwelling on the warnings of last October.
  • First, the government must clear the fog of ambiguity. Instead of abstract guidelines, the government should provide clear “Self-Diagnosis Checklists” that allow startups to determine their regulatory status with a simple Yes/No. Furthermore, “Regulatory Sandboxes” must be significantly expanded to protect innovation.
  • Second, enforcement equality must be demonstrated. To ensure the domestic agent system for overseas operators doesn’t become a paper tiger, specific responsibilities must be enforced, and tangible penalties applied for violations. This is the only way to resolve the sense of deprivation and reverse discrimination felt by domestic firms.
  • Third, push for “Mutual Recognition.” Korea must actively pursue Mutual Recognition Arrangements (MRA) with the EU and the US. Compliance with Korea’s AI Framework Act should function as a passport for safety in global markets.
The AI Framework Act is not the end; it is the beginning. It must evolve from text in a law book into a living system in the field. Whether the confusion of January 2026 is remembered as necessary “growing pains” or as a “wet blanket” that extinguished the spark of innovation depends on how the government and industry operate this law over the coming year.
